This Privacy Policy explains how [Possefy Group CO., LTD.] along with its affiliates (hereinafter referred to as “we”, “us” or “OnePlus”), collects, uses, shares, transfers and protects the personal data of the user (hereinafter referred to as “you”) and the corresponding rights of the user. Personal data refers to any information related to a natural person that has been identified or is identifiable. [1] Within the meaning applicable law, we will act as a data controller when we process your personal data.

II. How We Collect Personal Data and What Types of Personal Data We Collect

The term personal data is broadly defined and means any information relating to an identified or identifiable individual. This means that not only the data that, for example, identifies you directly, such as your name or address, is personal data but also other data, which when combined with other information accessible to us, enables us to link that data to you, for example, an IP address.

This channel for collecting personal data includes personal data that you provide to us directly, and collect from your personal device.

The personal data we collect depends on the environment in which you interact with us and the choices you make, including your privacy settings and the features and Services you use.

We may ask you to provide personal data or collect it under other circumstances such as in connection with marketing: Such activities include when you enter prize draws, use coupons or enter other competitions, participate in promotional or marketing activities organized by us or our business partners on our behalf, complete questionnaires or participate in user forums or blogs hosted by us or our business partners. To this extent, we may ask you to provide personal data such as your name, email address, phone number, ID/Passport Number, device name, device model, region, language settings, device identification number (IMEI number) and other personal data as indicated in connection with such activities.
In some jurisdictions we may be required to conduct real name authentication for certain Services you might use: In such a case, we will also collect your full name and details of your government-issued ID. If you refuse to provide such personal data, we may not be able to provide you with the corresponding Services.
In case we provide you with a message function to contact our service: We may collect Your Information including but not limited to your account ID, identity verification details, contact details, order details, etc.

III. How Long We Keep Your Personal Data

We will only store your personal data for as long as necessary to achieve the collection purposes set out in this Privacy Notice.

After the expiry of the aforementioned retention periods, we will delete or anonymize your personal data.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use and disclosure of your personal data, the purposes for which we process the personal data and the applicable legal requirements.

OnePlus Services may contain links to third-party websites, products, and services. You can choose whether to access websites or accept products and services provided by third parties or not. For example, the "Follow us" function on our official website provides links to our official social media accounts (such as Facebook, Instagram, LinkedIn, and Twitter) where you can view marketing or promotional information published by OnePlus.
We do not control third-party privacy and data protection policies and do not accept any responsibility or liability for such policies. At the same time, such third parties are not bound by this Privacy Notice. Therefore, before submitting personal data to third parties, we strongly recommend that you refer to the privacy protection practices of such third parties.

VI. How We Process Children's Personal Data

Our Services are mainly intended for adults. A child should not use our Services without his/her legal guardian's consent. We treat anyone less than the equivalent minimum age for full legal capacity in the relevant jurisdiction as a child. The definition of adults is based on the local laws that participants are located in.
If we discover that a child's personal data has been collected, we will delete the corresponding data as soon as possible.

Terms and Conditions

Entrants into the [Possefy Group CO., LTD.] shall be deemed to have accepted these Terms and Conditions. Please do not enter the Event if you do not agree to these terms and conditions.

The Event Registration is live from 22 May 2023 to 14 July 2023 in the OnePlus APAC region.

ELIGIBILITY:

You need to fulfil the following eligibility criteria to enter the Event:

(a) You should be an individual and legal resident of Thailand, Malaysia, Philippines, Indonesia, Vietnam, and Singapore.

(b) You have a billing address within the territory of Thailand, Malaysia, Philippines, Indonesia, Vietnam, and Singapore.

DETAILS OF THE EVENT:

Participants can join the activities at the OnePlus Magic Power Event website.
Limited availability: tickets will be issued by OnePlus and winner announcements will be released on the event website.
Limited privileges: 1 ticket per 1 OnePlus product purchased.
This event is eligible for OnePlus customers who purchased OnePlus 11 5G, OnePlus Nord CE 3 Lite 5G, or OnePlus upcoming smartphone in 2023 to register OnePlus Magic Power Event with Jackson Wang from 22 May 2023 - 14 July 2023 only.
Participants must submit full name, contact phone number, email, ID/Passport Number, country, OnePlus smartphone model, IMEI number and answer the questions completely in the form required.
The event is dedicated to OnePlus APAC 2023 smartphone buyers, the event organizer will select the winner from fans who buy smartphones in OnePlus APAC region within 2023 by checking the IMEI number.
Selected participants to receive free ticket will be determined by the answers provided in the form. Participants need to promise all personal information that he/she provides are correct.
Participants will be selected directly by OnePlus or one of its partners delegated by OnePlus.
Only the selected participants will have access to OnePlus Magic Power Event with QR Code (selected participants are not allowed to transfer, sell, change the name of the rights holder to others).
Results will be announced on 5 July 2023 and 17 July 2023; two rounds in total. Unique QR code will be sent via SMS and email after winner announcement via website. Winners need to confirm whether to join the event or not.
OnePlus offers no compensation (liability) for members of the group who are not selected to participate in the activity.
OnePlus won’t offer the payments for transportation, accommodation, etc. for participants.
Participants should be adults. The definition of adults is based on the country laws that participants are located in.
This activity is only opened to the public, and not to employees of, as well as their family members of OnePlus Group, along with its affiliates, relevant advertising agencies, and the campaign committee.

[Possefy Group CO., LTD.] reserves the right to revise the terms and conditions, determine eligible customer during the specified period only, and to change the premium for this activity without prior notice.
If the company checks and finds if any action has involved in fraud or participant fails to comply with the agreed terms and conditions, the company has the right to disqualify that participant without prior notice and shall not be held liable for any expenses or other damages incurred by that participant.
OnePlus will use your email address for future marketing usage.

ADDITIONAL TERMS:

Every ticket will be awarded \"AS IS\" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). There are no cash or other prize alternatives available in whole or in part. If selected participant rejects the ticket or in breach of these Terms and Conditions, the selected participant's ticket will be forfeited, and OnePlus shall be entitled to select another selected participant.

We may, to the maximum extent permitted by applicable law and in our sole discretion, change the T&Cs or cancel the Event at any time; or modify, terminate, or suspend the Event should viruses, worms, bugs, unauthorized human intervention, or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the event. We are not responsible for:

(a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the event, or by any technical or human error that may occur in the processing of entries;

(b) any printing or typographical errors in any materials associated with the event;

(c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or

(d) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the event.

We may, in our sole discretion, disqualify any individual found to be:

(a) tampering with the entry process or the operation of the contest or website or mobile application.

(b) acting in violation of these T&Cs; or

MISCELLANEOUS:

The Event is governed by the laws of the Republic of Thailand. No requests for transfer or assignment or redemption of the benefits shall be entertained. You agree that all our decisions related to the event are final and binding on you. Failure by OnePlus to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person. The decision of OnePlus shall at all times be binding and final. These T&Cs are subject to Thailand laws and the courts at Bangkok shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from.

FORCE MAJEURE:

This Event is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of OnePlus (\"Magic Power Event\"). OnePlus shall be not liable for any delay or adverse effect caused to the participants in the Event.

PUBLICITY RELEASE:

By accepting the Event, you give OnePlus and/or its affiliates permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the events and any promotions to follow. OnePlus shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen here > that OnePlus and/ or its affiliates have the right to publish your saved item details for any communication, promotions, or events that follow. You agree that OnePlus and/ or its affiliates have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation, etc. for the use of such pictures, etc., and hereby release OnePlus and/ or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use. You give your consent to OnePlus and/or its affiliates, agents and assigns to use your name and likeness to promote the contest and any promotions, events, or contest to follow.

LIABILITY RELEASE:

OnePlus accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the event or accepting the ticket. Nothing in these Terms and Conditions shall exclude the liability of OnePlus for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence. Please read the terms and conditions mentioned carefully. Non reading or not knowing any of the clauses will not absolve of any liability incurred. In no event shall OnePlus, including its officers, directors, and employees, be liable to you, or any third party, for any special, indirect, consequential losses, including but not limited to, damages for loss of use, loss of time, inconvenience, commercial loss, lost profits, lost business opportunities.
